Terms of Service

BalayHub (the "Platform", "we", "us") is an online classifieds marketplace operated for the Republic of the Philippines. These Terms are governed by Philippine law and any dispute is subject to the exclusive jurisdiction of the proper courts of the Philippines.
1. Nature of the Platform
BalayHub is a classifieds platform that hosts listings of real-estate properties submitted by their respective owners or by PRC-licensed brokers / salespersons and DHSUD-registered developers. We act as a passive intermediary providing information-society services within the meaning of Section 30 of Republic Act No. 8792 (Electronic Commerce Act of 2000).
We are NOT a real-estate broker, salesperson, appraiser or developer under Republic Act No. 9646 (Real Estate Service Act of the Philippines, 2009) and we do not act in any of those capacities. We do not negotiate, mediate, appraise, value or guarantee any property or transaction. The relationship between buyer and seller is direct; we are not a party to it.
2. Eligibility to post
You may post a listing on BalayHub only if you are either:
- The registered owner of the property, or the duly authorised representative of the owner (e.g. heirs, attorney-in-fact);
- A real-estate broker or salesperson holding a current and valid licence from the Professional Regulation Commission (PRC) and lawfully engaged by the owner to market the property; or
- A real-estate developer registered with the Department of Human Settlements and Urban Development (DHSUD) and authorised by the Securities and Exchange Commission (SEC) where applicable.
Anyone posting on behalf of an owner for compensation, without holding a PRC licence, is committing an offence under RESA. BalayHub will report such activity to the PRC.
3. Seller declarations and indemnity
By submitting a listing, you (the seller) expressly represent, warrant and declare under penalty of perjury that:
- You are the owner of the property, an authorised representative of the owner, or a PRC-licensed professional lawfully engaged by the owner;
- The information, photos, prices and amenities published are accurate to the best of your knowledge;
- The listing complies with all applicable Philippine laws, including but not limited to RESA, the Consumer Act, the Intellectual Property Code and the Data Privacy Act of 2012;
- You hold all the intellectual-property rights necessary to publish the photos, text and any other material in your listing.
You agree to indemnify, defend and hold harmless BalayHub, its shareholders, officers, employees and contractors from and against any claim, demand, lawsuit, fine, damage or expense (including reasonable attorney's fees) arising directly or indirectly from your listing, your use of the Platform, or your breach of these Terms.
4. Accounts
You are responsible for keeping your credentials secret and for any activity taking place under your account. If you suspect unauthorised access, reset your password immediately and contact us at info@balayhub.com. We may suspend or terminate an account that violates these Terms.
5. Listing moderation — scope and limits
Our review of submitted listings is intentionally narrow. We only verify that (i) the photos meet a basic quality bar and depict a property (not stock images, screenshots or watermarks from other sites) and (ii) the text is in legible English and meets a basic completeness threshold (a real description, a numerical price, a city / region). That is the entirety of our editorial check.
We do not verify property titles, deeds, tax declarations, HLURB / DHSUD licences to sell, or any other document of ownership. We do not verify the truthfulness of any claim in the listing — including but not limited to floor area, amenities, lot boundaries, occupancy status, encumbrances and price comparisons. We do not confirm that the person publishing has the right to publish on behalf of the owner. Those responsibilities lie entirely with the user who publishes, and they are stamped by the declarations the user must accept at submission (Section 3 above).
We may, at our sole discretion, refuse to publish, withdraw, edit or remove any listing that (a) violates these Terms, (b) violates applicable law, (c) infringes the rights of a third party, or (d) fails our quality bar. Removal is never a finding of liability against the seller — it is an editorial decision consistent with our role as a hosting intermediary.
Any party may submit a takedown request via /legal/takedown. We will review every substantiated request and act expeditiously to disable access to allegedly unlawful content, consistent with Section 30 of RA 8792.
6. Fees
As of the date these Terms take effect, posting a listing on BalayHub is free. We do not take a percentage or commission of any sale, lease or rental that may result from a listing. Should we introduce a paid plan or a listing fee in the future, we will do so by publishing updated Terms with a clearly stated price schedule. We will NEVER act as a party to the underlying real-estate transaction nor charge a success fee.
7. Disclaimers and limitation of liability
The Platform is provided "as is" and "as available". To the maximum extent permitted by Philippine law, BalayHub disclaims all warranties, express or implied, including the implied warranties of merchantability and fitness for a particular purpose.
BalayHub does not warrant: that any listing is accurate, current or lawful; that any seller holds good title; that any price is fair; that any party will perform on a transaction. Algorithmic price comparisons and mortgage calculators on the Platform are informational tools only and do NOT constitute an appraisal under RA 9646 or financial advice.
To the maximum extent permitted by law, BalayHub's aggregate liability arising out of or in connection with the Platform shall not exceed the greater of PHP 1,000 or the total fees you paid to us in the 12 months preceding the claim.
8. Data privacy
Our processing of personal data is governed by Republic Act No. 10173 (Data Privacy Act of 2012) and is described in our Privacy Policy. You may exercise any right granted to you under the DPA by contacting info@balayhub.com.
9. Records retention
We keep audit trails of seller attestations and licence verifications for at least five (5) years after the last activity on the related listing or account, consistent with the prescriptive periods under Philippine law. Verification documents uploaded by professional users are stored privately and accessible only to BalayHub administrators.
10. Governing law and forum
These Terms are governed by the laws of the Republic of the Philippines. Any dispute arising from or related to these Terms or the Platform is subject to the exclusive jurisdiction of the proper courts of the City of Makati, Metro Manila, Philippines, without prejudice to mandatory consumer-protection forums.
